Newly Defined Legal Separation In California
When referring to legal separation, the California Family Code previously employed the phrase “living separate and apart.”
This simple terminology made it impossible for couples to continue living together if they wished to end their marital relationship. In fact, it was necessary for at least one spouse to leave the joint home before a legal separation could even be processed and finalized.
As of January 1st, 2017, however, this phrase was eliminated from section 70(a) of the Family Code which now allows couples to continue living under the same roof.
If you and your partner choose to separate, your legal standing as a couple can no longer be defined by where you live.
